TERMS AND CONDITIONS FOR USERS

 These Terms and Conditions (“Terms”) govern your access to and use of the mobile application and website operated under the name “Sealed” (collectively referred to as the “Platform”), owned and operated by Suguna Stamp and Seal Private Limited, a company incorporated under the laws of India, having its registered office at No: 273, Purasawalkam High Road, Opp. Saravana Stores, Chennai – 600 007 (hereinafter referred to as “Company”, “Sealed”, “We”, “Us” or “Our”).

By accessing, registering on, or using the Platform, you (“User”, “You”, or “Your”) agree to be bound by these Terms and the Privacy Policy, which is incorporated herein by reference.  If you do not agree to these Terms, you are advised not to use the Platform.

The Platform is a technology-based intermediary that enables Users to avail delivery-related services offered by independent third-party delivery partners. The Company does not provide delivery services directly.

I. SERVICES

The Platform facilitates services including but not limited to parcel pickup and delivery, essential delivery services, print-on-the-go services, procurement and delivery of documents, and related ancillary services. The Company operates as a technology-enabled platform that facilitates the booking, coordination, and management of delivery services between Users and independent delivery partners. While the Company enables order placement, assignment, tracking, and customer support through the Platform, the actual execution of delivery services is carried out by independent delivery partners.

Accordingly, the Company shall not be deemed to be the direct provider of delivery services and does not assume liability for acts or omissions of delivery partners beyond its reasonable control. However, the Company may, at its sole discretion, provide support, coordination, and resolution assistance in relation to services booked through the Platform.

II. ELIGIBILITY AND USER ACCOUNT

You represent and warrant that you are at least eighteen (18) years of age and are competent to enter into legally binding agreements. You agree to provide true, accurate, current and complete information during registration and use of the Platform.

Registration on the Platform shall be completed using a valid mobile number through a one-time password verification process. You shall be responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

The Company reserves the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or incomplete.

III. PLATFORM PERMISSIONS AND DATA ACCESS

In order to provide the Services effectively, the Platform may require access to certain device features and information including but not limited to location services, camera, media storage, contact list, and device information.

You hereby grant explicit consent for the Platform to access such features as may be necessary for the functioning of the Services, including but not limited to real-time location tracking for order fulfillment, uploading images or documents, and facilitating communication with delivery partners.

IV. OPERATION OF PLATFORM AND SERVICE REQUEST

Upon placing a service request on the Platform, the request shall be transmitted to available delivery partners. A delivery partner may accept or reject such request at their sole discretion.

Once a service request is accepted, the User shall receive relevant details of the delivery partner. Upon such acceptance, the pickup and drop addresses provided by the User shall be deemed final and shall not be modified. Any change in such details shall require cancellation of the existing order and placement of a new request.

The User acknowledges that certain services may require uploading of images or documents for verification purposes, including but not limited to order confirmation and proof of delivery.

The Platform may display parcel specifications including weight, size, and vehicle suitability requirements, and the User agrees to comply with such requirements.

V. CANCELLATION POLICY

The User is permitted to cancel service requests subject to the conditions specified herein. The Company may impose restrictions on excessive cancellations, particularly in cases where cancellations occur after a delivery partner has accepted the service request.

In the event that the User cancels service requests more than three (3) times within a specified period, the Company reserves the right to impose penalties, including but not limited to cancellation charges, temporary restrictions on account usage, or suspension of further service requests. Any cancellation initiated beyond such limit, including the fourth (4th) and subsequent cancellations, may attract additional penalties as determined by the Company at its sole discretion.

Where a service request is cancelled after acceptance by a delivery partner, the User may be liable to pay applicable cancellation charges or penalties, considering the time, effort, and resources allocated by the delivery partner.

Cancellation charges may vary depending on the stage of the order at which cancellation is initiated, and the Company reserves the right to determine such charges at its sole discretion.

VI. PARCEL REQUIREMENTS AND USER RESPONSIBILITY

The User shall ensure that all details provided in relation to the parcel, including but not limited to weight, dimensions, and nature of the contents, are accurate and complete at the time of placing the service request.

The Platform may display permissible limits relating to parcel size, weight, and vehicle suitability. The User agrees to comply with such requirements.

In the event that the actual parcel exceeds the declared specifications, and the delivery partner nevertheless agrees to proceed with the delivery, such acceptance shall be at the sole risk and responsibility of the User. The Company shall not be liable for any consequences arising from incorrect or misleading parcel information, including but not limited to additional charges, refusal of service, delay, damage, or disputes with the delivery partner.

The User further agrees that any additional amount agreed upon with the delivery partner due to excess weight, size, or special handling shall be settled directly with the delivery partner, and the Company shall bear no responsibility in relation thereto.

VII. REFUND POLICY 

All payments made through the Platform are subject to the terms specified herein. In the event of cancellation of an order prior to acceptance by a delivery partner, any payment made may be refunded in accordance with the Company’s policies.

In cases where the service has been partially or fully rendered, refunds shall not be provided except in circumstances where the Company determines, at its sole discretion, that a refund is warranted due to service failure attributable to the Platform.

Any voluntary payment, including tips or additional amounts paid directly or indirectly to delivery partners, shall not be subject to refund and the Company shall bear no responsibility in relation to such payments.

VIII. PAYMENTS

The User agrees to pay all applicable charges for services availed through the Platform. Payments may be made through online payment gateways, Unified Payments Interface (UPI), card-based payments, or other methods as enabled on the Platform.

The Company utilizes third-party payment service providers for processing transactions and shall not be liable for any issues arising from such third-party services.

IX. USER OBLIGATIONS AND CONDUCT

The User agrees to use the Platform in compliance with all applicable laws and shall not engage in any unlawful, fraudulent, or abusive activities. The User shall not attempt to disrupt the functioning of the Platform or misuse any features provided therein.

The User further agrees not to request delivery of any prohibited, illegal, hazardous, or restricted items under applicable law.

X. DISCLAIMERS

The Company does not guarantee the availability, timeliness, or quality of services provided by delivery partners. The delivery partners are independent contractors and the Company shall not be liable for any acts, omissions, or negligence on their part.

The Platform is provided on an “as is” and “as available” basis without any warranties, express or implied.

XI. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Platform.

The aggregate liability of the Company, if any, shall be limited to the amount paid by the User for the specific service in question.

XII. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Platform, including but not limited to its design, content, and software, shall remain the exclusive property of the Company. 

XIII. TERMINATION

The Company reserves the right to suspend or terminate your access to the Platform at any time in the event of violation of these Terms or misuse of the Platform.

XIV. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. The courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

XV. MODIFICATIONS

The Company reserves the right to modify these Terms at any time. Continued use of the Platform after such modifications shall constitute acceptance of the revised Terms.

XVIII. GRIEVANCE REDRESSAL

In accordance with applicable laws, including the Information Technology Act, 2000 and rules made thereunder, any grievances, complaints, or concerns with respect to the Platform or Services may be addressed to the Company at the registered email address mentioned above.

The Company shall make reasonable efforts to resolve such grievances within a reasonable period as prescribed under applicable laws.
